There was an accident in Pakistan
and someone was hurt

After an accident there is a police report, and then there can be two cases: one against the driver as a crime, and one for money for the injured person or the family. This page shows how the two fit together, what compensation means in Pakistan, and what an advocate does for a family that is abroad.

Where this applies This page covers a road accident in Pakistan. Insurance and compensation for an accident that happened in another country are that country’s matter.

What this is about

The police report is the start. It records who was driving, what happened, and who was hurt. From it, the criminal case against the driver runs in the magistrate’s court. Separately, the injured person or the family of someone who died can claim money: from the driver, from the owner of the vehicle, and where there was insurance, from the insurer. In a case where someone died, the claim can also be settled between the families, and the settlement then affects the criminal case.

For a family abroad, the difficulty is that the settlement is often pressed on them quickly, by people who know the family is far away. An advocate on the ground reads the report, values the claim, and does not let the family sign anything on the first day.

What has to be in place

What has to be clear.

  1. That a police report was made, and what it says.

  2. Who was driving, who owned the vehicle, and whether it was insured.

  3. The medical papers, or the death certificate.

Note Your advocate confirms which of these apply to your case.

The documents you will be asked for

The papers an advocate asks for.

  • The police report.
  • The medical record, or the death certificate and the burial record.
  • The vehicle details, and any insurance paper.
  • Identity documents of the injured person or the heirs.

How an advocate helps from where you are

What an advocate does.

  • Gets the report registered correctly, and sees that the investigation moves.
  • Files the claim for compensation in the right court and against the right people.
  • Negotiates a settlement where the family wants one, and writes it so that it holds.
  • Appears in the criminal case for the family, so that it does not run without them.

What to ask before you agree

  • What does the police report say, and is it correct?
  • Who can be claimed against: the driver, the owner, the insurer?
  • If the family wants to settle, how is it written so that it holds?
  • What do you need from me, and by when?
  • What is your fee, and what is not included in it?
