Guide
I want to send a legal notice,
or I have received one
A legal notice is a letter from an advocate, sent before a case. It says what the sender claims, what they want done, and by when. It is not a court order, and ignoring it is not a crime. But it is usually the last thing that happens before a case, and how you answer it matters.
Where this applies This page covers notices sent and received in Pakistan. A notice about something in the country you live in is a matter for an advocate there.
What this is about
People send a notice for two reasons: to put a demand on record before filing, and because for some claims the law expects a notice first. People receive one for the same reasons. In both directions the notice sets the story the court will later read, so the wording is not a formality.
A notice with your name on it, delivered to a family address in Pakistan while you are abroad, is common. It does not become less real because you did not see it.
What has to be in place
What has to be clear.
What the claim is, in one sentence.
Who the other side is, and an address where a notice reaches them.
The papers that support the claim, or that answer it.
Note Your advocate confirms which of these apply to your case.
The documents you will be asked for
What an advocate asks for.
- The notice you received, if you received one, with the envelope or the date it arrived.
- The agreement, deed, or correspondence the dispute is about.
- Your identity document and a power of attorney.
How an advocate helps from where you are
What an advocate does.
- Drafts the notice so that it states the claim the way a court will later expect to see it.
- Answers a notice you received, on time, without conceding what should not be conceded.
- Tells you whether a case is likely to follow, and what it would involve.
What to ask before you agree
- Have you seen the notice, and what does it actually claim?
- By when does an answer have to go, and what should it not concede?
- Is a case likely to follow, and what would it involve for me abroad?
- What do you need from me, and by when?
- What is your fee, and what is not included in it?
